Cover up the case of enforced disappearance, Ratification of Convention on anti Enforced Disappearance

IKOHI’s member of board , AFAD and Kontras have met Tuesday on March 11 with the National Commission on Human Rights (Komnas HAM) in a bid to raise its supports for missing persons and victims of violence cases in Indonesia.

The meeting was held between one of Komnas Ham’s commissioner Djoni Simanjuntak with Mugiyanto IKOHI Chairmain who also serves as the President of AFAD, Sri from international division of KONTRAS and others.
  
On this special opportunity, IKOHI as organisation of victim enforced disappearance and other human right violation need to state some points :

  1. In UNWGEID report released on January 10, 2008 and it will inform in the Human Right council of UN meeting that on 2007, it says that they have been received report of 5 disappearance cases from Indonesia. 5 disappearance cases are 3 Toyado cases from Central Sulawesi on behalf of Iwan Ronti, Hasyim Toana, and Aswat Lamarati, and 2 cases of ’65 tragedy, they are Rohadi Iwan Hadi Subroto and Madum Budi Martono. Those five cases had been inform to Indonesian government by UNWGEID for clarification. But until January 10th, 2008 Indonesian government didn’t answer UNWGEID request to have official visiting in Indonesia, although they has asked it since 2 years ago.
  2. As UN member and member of UN Human rights Council, Indonesia on 12 March 2007 on High Level Segment, through speech of Ministry of human right and law, Hamid Awaluddin says soon will sign Convention on the Protection of All Persons From Enforced   or Involuntary Disappearances. In some audiences IKOHI and  Foreign Affairs Department, Human Right and Law Department,   They gave the same promise. In the other hand, until now the convention is not signed yet,  let alone ratification.
  3. As prevention effort, assurance for certainty law and to fulfill victims rights and victim families rights for truth, justice and recovery, IKOHI expects involuntary disappearance cases of pro democracy in 1997/1998 which its bunch in attorney general (jaksa agung) have to investigate rapidly. Mainly, in Constitution Court decision on February 21st, has state clearly on it.

According those 3 points, we insist komnas HAM as national independent institute which handle human rights violation cases in Indonesia, has to do something that are :

  1.  Call on Indonesia government (c.q. President of Indonesia Republic) to work cooperatively with UNWGEID (UN Working Group for Enforced or Involuntary Disappearences) for seeking the 5 disappeared persons. The Government must give  answers presently for UNWGEID to implement its mandate in Indonesia.
  2.  Call on Indonesian Government and Representative Council of Republic of Indonesia (DPR RI) to accomplish soon their promise to sign and ratify Convention for Anti Enforced Disappearance as commitment from Indonesia to protect and preserve for human rights in Indonesia.

Ask President to give an order to General Attorney to follow Constitution Court decisiveness on February 21st, 2008 and investigate disappearance cases of pro democracy activist in 1997/1998 immediately.

The commissioner gave a slight response but he promised will converse 3 Toyada cases from Central Sulawesi to official from police head office next  week.
